Attorney General Says No To Plea Against Swara Bhaskar

The Attorney General is the authorised person whose nod is a must before filing a contempt petition in the top court.

The Attorney General of India nod to file contempt plea against actress Swara Bhasker for comments on the Supreme Court’s verdict in the Babri Masjid and Ayodhya land dispute case. As per the petitioner, the comments were “derogatory”, “scandalous” and an “attack on the institution”.

Attorney General KK Venugopal, while defending Swara Bhaskar said that the perception of the speaker did not offer any comment on the Supreme Court itself or say anything that would scandalize or tend to scandalize the authority of the Supreme Court. All in all, the Attorney General while winding up told that, this statement does not constitute criminal contempt. In his statement, he cleared that within the first part, the actor is presenting facts, and in the second part, she is presenting her view.

Lets have a look upon the statements given by actress in the Attorney General’s letter: Reportedly, the first statement which gained a massive amount of controversy says that we are living in a country where the Supreme Court states that the demolition of the Babri Masjid was unlawful and, in the same judgment, rewards the same people who brought down the mosque.

While in the second statement Ms. Bhaskar said that we are ruled by a government that doesn’t believe in our Constitution… we are ruled by police forces that do not believe in the Constitution… it seems we are now in a situation where our courts are not sure whether they believe in the Constitution.

In November last year the Supreme Court had ruled that the formerly disputed land in Ayodhya belonged to the deity Ram Lalla. However, it also said that the razing of the 16th century Babri Masjid in December 1992 was unlawful and a “calculated act of destroying a place of public worship”. The decision back then received mixed reactions.

However, the refusal from the Attorney general came as soon as lawyer-activist Prashant Bhushan was found guilty in the same charge. According to the court, he had crossed a line in making comments about the judiciary. Above all Swara Bhaskar was in headlines back when the protests against CAA hiked in Delhi.
